Terms of Use

1. Acceptance of the Terms

These Terms govern your use of TopTier Prep Hub at toptierprephub.com. By using or registering for the platform, you agree to these Terms and acknowledge and agree to the applicable provisions of our Privacy Policy. If you do not agree, do not register or continue using the service. Acknowledging the policy does not waive privacy rights or provide blanket consent for unrelated uses of personal data.

2. Eligibility

You must be legally capable of entering this agreement. If you are under 18 or otherwise require a legal representative, use the platform only with permission and appropriate involvement of your parent or legal guardian. Do not misrepresent your age or identity.

3. Account responsibilities

• Provide accurate account and profile information and keep it reasonably up to date.
• Protect your Google account, sessions, and devices.
• Do not share, sell, or transfer your account or Premium access to another person.
• Notify support promptly if you suspect unauthorized access.
• Accept responsibility for activity you perform or authorize through your account. Responsibility for disputed unauthorized activity will be assessed fairly in light of the circumstances and applicable law.

4. Educational purpose

TopTier Prep Hub is an independent online Fisheries Professional Licensure Examination review platform. It is not affiliated with, endorsed by, or operated by the Professional Regulation Commission (PRC).

Questions, explanations, analytics, readiness scores, and projections are educational tools. They may contain errors or differ from the coverage, format, or standards of an actual examination. Readiness scores are not official PRC predictions. The platform does not guarantee that you will pass the FPLE, obtain a license, or achieve a particular score. Consult official PRC announcements for examination requirements.

5. Free and Premium services

Free access may have limits on difficulty, item counts, question-bank access, analytics, and daily use. Premium gives access to the features described on the current pricing and upgrade page, subject to the disclosed offer and these Terms.

Features and limits may change as the platform develops. We will give reasonable notice of material changes affecting paid access and address substantially reduced paid benefits fairly, including remedies required by law. Promotional or trial access follows its stated conditions and expiration; a trial does not authorize a charge.

6. Payments and activation

Review the displayed price, subscription duration, and instructions before paying or requesting activation. The current public process involves payment using the displayed instructions, receipt upload, and manual administrator verification. Submitting a request does not mean Premium has been activated; verification may be necessary before access begins.

Provide a genuine, readable receipt and accurate payment information. We may request clarification when a payment cannot be matched or verified. Fraudulent or altered receipts may result in rejection or proportionate account suspension. Contact support about an incorrect payment or activation problem; do not send another payment merely because review is pending.

7. Renewal, expiration, cancellation, and refunds

The public offer currently displays a monthly price. Subscription duration and any renewal conditions are shown before payment; review the current offer and ask support about anything unclear. Your account shows the approved Premium expiration. Administrator verification determines activation under the purchased offer.

The current public receipt-verification flow does not automatically renew or charge you on a recurring basis. You may stop purchasing or renewing Premium without a recurring-billing cancellation step. When paid or trial Premium expires, access returns to the applicable Free Plan, unless another disclosed promotion or entitlement applies.

For cancellation, an activation dispute, or a refund request, email support with the account email and relevant transaction reference. Refunds are evaluated according to the circumstances, the disclosed service conditions, and applicable Philippine consumer law, including cases involving duplicate payments, failure to provide paid access, or material service problems. We may need information to verify the transaction; approval is not automatic, and these Terms do not impose a blanket no-refund rule.

Nothing here removes rights or remedies that cannot legally be waived.

8. Acceptable use

You must not:

• Scrape or bulk-extract the question bank, or copy, republish, resell, or distribute questions and explanations without authorization, except as permitted by law.
• Share or sell accounts, or circumvent Premium or other access restrictions.
• Manipulate scores, Shells, Tide XP, streaks, leaderboards, rewards, or exam records.
• Use automation for abuse or make excessive requests that disrupt the service.
• Upload malware, interfere with security, or attempt unauthorized access to accounts, databases, or systems.
• Harass users or support personnel, infringe another person's rights, or use the service unlawfully.

9. Intellectual property and study license

TopTier Prep Hub's original branding, interface, question-bank content, explanations, graphics, software, analytics presentation, and written materials are protected by applicable intellectual-property laws. Rights in properly licensed third-party materials, public-domain material, user-owned submissions, and other parties' trademarks remain with their respective owners or in the public domain, as applicable. We do not claim ownership of facts themselves.

Subject to these Terms and your access level, you receive a limited, personal, non-exclusive, non-transferable, revocable license to use the service for individual study. Revocation is subject to the suspension and termination provisions below and mandatory rights. This license does not authorize redistribution or commercial exploitation of the question bank. 10. User submissions

You retain ownership of your original receipts, feedback, reports, profile information, and support messages. You give us only the limited permission needed to receive, store, review, and process those submissions to provide the service, investigate reports, and make requested corrections, consistently with the Privacy Policy. This is not a transfer of ownership or permission for unrelated commercial use.

Submit only information you are entitled to provide. Payment receipts must not be made public by the platform or posted by users in public features; use the designated private verification flow.

11. Question reports and corrections

You can report questions or explanations that appear incorrect, unclear, outdated, or inappropriate through the available report tool or support. Include enough context for review. We may investigate and correct, update, or remove content. A report does not guarantee a particular outcome or immediate revision; corrections may affect future study content or calculations.

12. Service availability

Maintenance, network issues, errors, or failures of hosting, authentication, database, or other third-party services may interrupt access. We do not guarantee uninterrupted or error-free service. We will make reasonable efforts to address problems and communicate significant planned interruptions where practicable.

13. Suspension and termination

We may proportionately restrict, suspend, or terminate access for fraud, abuse, security threats, unlawful conduct, or a material violation of these Terms. Urgent threats may require immediate action. Where appropriate, we will explain the reason, provide notice or an opportunity to correct the issue, and allow an appeal through support.

You may stop using the service and contact support about account closure. Termination does not automatically resolve a payment dispute or erase records that must lawfully be retained. Accrued rights, applicable payment remedies, and provisions that reasonably need to survive termination remain effective.

14. Disclaimers

Use review materials with your own judgment and alongside appropriate study resources. We take reasonable care in operating the platform, but cannot promise that every question or calculation is complete, current, or suitable for every learner. External content and services are subject to their own terms.

These qualifications do not excuse a failure to meet a legal obligation, remove mandatory service standards, or exclude responsibility for negligence where the law does not permit that exclusion.

15. Limitation of liability

To the extent permitted by applicable law, we are not liable for indirect or consequential losses that were not reasonably foreseeable when the agreement was made. Any limitation applies only where lawful and appropriate to the circumstances; liability will otherwise be determined under applicable law.

Nothing excludes liability for fraud, willful misconduct, or any loss or responsibility that cannot lawfully be excluded or limited. Mandatory consumer and privacy rights, including available remedies, remain unaffected.

16. Indemnity

To the extent permitted by law, you are responsible for reasonable, substantiated losses arising from third-party claims directly caused by your unlawful misuse, infringement of another person's rights, or material violation of these Terms. This does not cover losses caused by our own fault or conduct for which you are not responsible.

We will give reasonable notice of a claim and an opportunity to respond or participate in its defense. We will not agree to a settlement imposing an obligation on you without your agreement. Any recovery must be proportionate to your responsibility and cannot duplicate compensation already received.

17. Governing law

These Terms are governed by the laws of the Republic of the Philippines. You may contact support to seek an informal resolution, but doing so is not a condition that removes access to courts, regulators, or mandatory consumer remedies. No provision removes any mandatory rights available to consumers.

18. Changes to the Terms

We may revise these Terms to reflect service or legal changes. We will communicate material changes through the website, an account notice, or email where appropriate, update the date, and identify when the changes take effect. Where required, we will seek renewed agreement. Changes will not retroactively remove accrued rights or lawful remedies relating to earlier purchases.

19. Severability and entire agreement

If a provision is held invalid or unenforceable, the remaining provisions continue to apply to the extent legally possible. These Terms, the Privacy Policy, and any applicable offer conditions disclosed and accepted at purchase form the agreement for your use of the service. They do not override mandatory law or eliminate responsibility for misleading representations. A failure to enforce a provision immediately does not waive the right to enforce it later.
